These terms apply when you ask us for a quote and when you order a media wall or other work from Hutton Media Walls Ltd. Please read them with your quote, our privacy policy. If you're a consumer, nothing in these terms affects your legal rights.
1. About us
Hutton Media Walls Ltd, registered in Northern Ireland, company number NI744732, registered office and showroom 21J Enterprise Road, Bangor, BT19 7TA. We are not currently registered for VAT. Contact us on 07521 575963 or info@huttonmediawalls.co.uk.
2. Quotes and prices
- Prices on our website are package prices for supply and fit. We are not currently VAT registered, so no VAT is added to our prices. Your final price is the one in your written quote, which is based on measuring your actual wall.
- Quotes are valid for 7 days from the date on the quote. After that, we may need to re-check prices before we can go ahead.
- Packages don't include electrical work such as new or moved sockets, unless it's listed in your quote.
- If, once work starts, we find something neither of us could reasonably have known about (for example hidden pipes or cables, or a wall that isn't sound enough to fix to), we'll stop, explain the options and agree any change in price with you before we carry on. We won't charge for extra work you haven't agreed to.
- Designs made in our online planner, and the colours and swatches on screen, are a guide only. They aren't a quote or an exact representation of the finished wall.
3. Your order and deposit
- Your order is confirmed once you accept our written quote and pay the 30% deposit. We'll then confirm your order, what's included and your install date in writing.
- Deposit: 30% of the quoted price, payable when you accept the quote. We use it to order the materials for your wall.
- Balance: the remaining 70% is due on the day the work is completed. Payment methods: bank transfer, credit card or finance. Finance is subject to status and approval by the finance provider.
- If you want to change your design after we've ordered materials, we'll tell you whether the change is possible and any effect on the price and date before we go ahead.
4. Made-to-measure goods
Many of the items we supply are made or cut to your measurements and chosen finishes. Natural materials and printed finishes (such as wood, stone or marble effects) vary slightly between batches and from on-screen images; this isn't a fault. Please check your design, sizes and finishes carefully before you accept the quote.
5. What we ask of you
- Give us safe access to the room on the agreed date and, where possible, clear the area around the wall.
- Tell us about anything you know of in or on the wall, such as pipes, cables, damp or recent plastering.
- Make sure the TV and any other devices we're fitting are yours and in working order. We aren't responsible for faults in your own equipment.
- Let us know if parking near your home is restricted.
6. Fitting dates and delays
We'll agree a fitting date with you and keep you updated. Most installs are completed in a day. If something outside our control (such as supplier delays, illness or severe weather) delays your job, we'll tell you as soon as we can and agree a new date. If the delay is significant you can cancel and we'll refund anything you've paid for goods or work you haven't received. If you need to move your date, please give us at least 48 hours' notice. If you give us less than 48 hours' notice, we'll keep 10% of your deposit. This is our genuine estimate of the loss caused by a late change: our self-employed fitters are booked for your job and lose that day's work at short notice. The rest of your deposit stays towards your order and your new date.
[SOLICITOR TO REVIEW: the 10% late-change charge on the deposit. Please check it is fair and enforceable under the Consumer Rights Act 2015 (including the rules on unfair terms) and fits with customers' statutory cancellation rights.]
7. Electrical work
Any electrical work, such as moving or adding sockets, will be carried out by a suitably qualified electrician and is only included if it's in your quote.
8. Ownership and risk
The goods become yours once we've been paid in full. Responsibility for the goods passes to you once they're fitted in your home.
9. Our guarantee and your legal rights
- We guarantee our workmanship for 1 year from the date of fitting. If something we fitted fails because of our workmanship, we'll put it right free of charge.
- Electric fires, LED lighting, TV brackets and other manufactured products also come with the manufacturer's warranty, which we'll help you claim.
- The guarantee doesn't cover damage caused by misuse, accidents, alterations made by someone else, or normal wear and tear.
- This guarantee is in addition to your legal rights. Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality, and services must be carried out with reasonable care and skill. For more information, contact Consumerline (Northern Ireland), Advice Direct Scotland (if you live in Scotland) or Citizens Advice.
10. Our responsibility for loss or damage
- We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We'll make good any damage we cause to your property while working.
- We aren't responsible for problems caused by existing defects in your walls, wiring or plumbing that we couldn't reasonably have known about, or for business losses (our services are for domestic use).
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law, including your rights under the Consumer Rights Act 2015.
11. Photos of your wall
We may take photos of the finished wall for our records. We'll only use them on our website or social media if you agree, and we won't show your address or anyone in your household.
12. Cancelling
If you're a consumer, you have legal rights to cancel in some situations and to a repair, replacement or refund if something we supply is faulty. Nothing in these terms takes those rights away. If you want to cancel an order, contact us as soon as possible on 07521 575963 or info@huttonmediawalls.co.uk. Made-to-measure items cannot normally be cancelled once we have started making them, and the 48 hours' notice rule for moving an install date also applies.
13. Complaints
If you're not happy, please contact us first on 07521 575963 or info@huttonmediawalls.co.uk. We'll acknowledge your complaint within 2 working days and aim to give you a full response within 14 days. If we need longer, we'll tell you why and when to expect it.
14. Law
These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland can hear any dispute. If you live elsewhere in the UK, you can also bring proceedings in your local courts.
If you live in Scotland, you can bring legal proceedings about our goods or services in either the Scottish or the Northern Irish courts.
[SOLICITOR TO REVIEW: governing law, courts and consumer rights wording for customers in Scotland. Scots law gives consumers some different rights, so please have this section checked before taking orders from Scotland.]
15. Changes to these terms
We may update these terms. The version that applies to your order is the one in place when you accepted your quote.
